1. Agreement to these terms

By using www.mutamento.store (the "Site") or placing an order, you agree to these Terms and Conditions ("Terms"). If you do not agree, do not use the Site.

The Site is operated by Marissa Fontana LLC, a Pennsylvania LLC ("we," "us," or "our").

You must be at least 18 years old, or the age of majority where you live, to place an order. Our Privacy Policy explains how we collect and use your information and is part of these Terms.

2. Products, pricing and orders

We try to describe and photograph our products accurately. Colors, sizes and finishes may vary slightly from what appears on your screen.

Prices are listed in U.S. dollars and do not include taxes or shipping unless stated. Applicable sales tax and shipping charges are shown at checkout before you pay.

Your order is an offer to buy. We accept it when we ship the item and send a shipping confirmation. We may refuse or cancel any order, including for suspected fraud, limited stock, or a pricing or description error. If we cancel after charging you, we will refund the full amount.

Payment is due in full at checkout. We do not store full card numbers. You confirm you are authorized to use the payment method you provide.

3. Shipping, returns and refunds

We ship to the continental United States only. Delivery times shown at checkout are estimates, not guarantees. Title and risk of loss pass to you when we hand the package to the carrier.

If an item arrives damaged or wrong, contact us within 7 days of delivery with your order number and photos. Because many of our items are one of a kind, we cannot offer replacements. Instead, you may choose a full refund, including original shipping, or store credit for the same amount.

Curated sets. Some products are sets of multiple items sold together. If one item in a set arrives damaged or wrong, we will refund or credit the estimated value of that individual item, as reasonably determined by us, rather than the full price of the set.

You may return unused items in original packaging within 14 days of delivery for a refund of the purchase price. To start a return, email hello@mutamento.store. Unless the item was damaged or wrong, you pay return shipping, and original shipping charges are not refundable.

Sets can be returned only as a complete set. Every item must be received in its original condition and packaging. If any item is missing, used or damaged, the set is not eligible for return.

Return shipping. You are responsible for returned items until we receive them. Please pack returns securely; we recommend a tracked, insured shipping service. Items that arrive damaged or lost in return shipping are not eligible for a refund or store credit.

For hygiene and safety reasons, ritual oils, lotions, balms, sprays, bath products, incense, candles and other personal-care or consumable products are final sale and cannot be returned, whether opened or unopened. Final-sale and personalized items also cannot be returned. This does not affect your right to a refund or store credit if one of these items arrives damaged or wrong.

Refunds go to your original payment method within 10 business days after we receive and inspect the return.

4. Reviews and other content you post

You may post reviews, ratings, photos and comments ("User Content"). Honest reviews are welcome, positive or negative, and nothing in these Terms limits your right to share an honest opinion of our products.

You keep ownership of your User Content. By posting it, you give us a non-exclusive, royalty-free, worldwide license to display, reproduce and share it on the Site and in our marketing, with your display name.

You agree that your User Content:

• reflects your own genuine experience with the product
• does not infringe anyone's copyright, trademark, privacy or other rights
• is not unlawful, threatening, obscene or harassing
• discloses any payment, free product or other connection to us

We may remove User Content that breaks these rules, is off-topic, or is spam.

5. Our content and acceptable use

The Site's text, images, logos and design belong to us or our licensors and are protected by copyright and trademark law. You may view and print pages for personal, non-commercial use only.

You agree not to misuse the Site, including by scraping it, interfering with its operation, attempting unauthorized access, or using it for fraud.

6. Warranties

Except as required by law, the Site and products are provided "as is," and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.

7. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

These limits do not apply where the law forbids them, such as for personal injury caused by our negligence.

8. Indemnity

You agree to cover our reasonable losses and legal costs from claims caused by your User Content or your breach of these Terms.

9. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania and the Federal Arbitration Act, without regard to conflict-of-law rules.

Binding arbitration. Any dispute arising from these Terms, the Site or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Northhampton County, Pennsylvania, or by phone or video if you prefer. We will pay any filing and arbitrator fees beyond what the AAA rules require you to pay.

No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine claims of more than one person.

Exceptions. Either party may bring an eligible claim in small claims court, or seek an injunction for intellectual property misuse. To enter judgment on an arbitration award, either party may go to the state or federal courts located in Northhampton County, Pennsylvania.

Opting out. You may opt out of this arbitration agreement by emailing hello@mutamento.store within 30 days of your first purchase. If you opt out, disputes will be resolved in the courts named above.

Before filing a claim, please contact us so we can try to resolve it informally within 30 days.

10. Changes and other terms

We may update these Terms by posting a new version with a new "Last updated" date. Changes apply to orders placed after that date.

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
